What are the tax benefits of a 1031 exchange?

A 1031 exchange offers multiple tax benefits. Most importantly, a 1031 exchange allows investors to defer paying capital gains; therefore, they have more capital to invest. In addition, a 1031 exchange permits investors to reset the depreciation schedule on their investments.

What qualifies as a like-kind property?

The IRS defines like-kind property as a property that is the same in nature or character but can differ in grade and quality. Like-kind properties include commercial assets, residential assets held for investment purposes, and fractional interest in DSTs.

Who qualifies for a 1031 exchange?

Most individuals and partnerships qualify for a 1031 exchange; restrictions are instead focused on the type of property traded. Individuals, C corporations, S corporations, partnerships (general or limited), limited liability companies, trusts, and any other taxpaying entity may qualify for a 1031 exchange.

Can an investor hold the funds between selling and buying a property?

A qualified intermediary (QI) must always be used for a 1031 exchange. Once the relinquished property sells, the proceeds from the sale must be held with the QI. The QI directs the funds for closing on the replacement property as well. Funds held with any person other than the QI are taxable.

When does an investor need to pay taxes in a 1031 exchange?

Investors must invest the total value of the relinquished property into a replacement property. Any amount that is not reinvested is taxable.
